Terms and Conditions

Our Agreement

All direct bookings are made with Gekko Safari (ABN 44094842593). By booking a trip with us whether over the phone, by email as well as online bookings you make on our website or on our related sites (including travel agents and partners) you are deemed to have read, understood and agreed to the Terms & Conditions outlined below, which at the time of booking becomes the entire agreement (the contract) between you and us. We will accept your booking on this basis.

Information Regarding Covid19

The health and safety of our passengers, staff and community are our priority

We ask all passengers.

If you are feeling unwell with cold or flu-like symptoms please do not join the tour or get tested prior to joining the tour to confirm your symptoms are not COVID related.

When you join the tour, your guide will brief you on the hygiene practices we recommend to follow whilst on tour. We will carry hand sanitiser and cleaning products; there will be signage on the truck as a reminder to follow best hygiene practices. We recommend all passengers bring a mask with them, it is your choice whether you want to wear it or not. If you test positive before the tour departs or whilst on tour, you will not be able to join the tour or you will need to leave the tour at the next closest town. You will be responsible for all costs associated with leaving the tour. It will be up to you to make your way to the tour’s end destination at your own cost. 

We highly recommend all passengers take out travel insurance and make sure they are covered for such an event.

Health and Fitness

You are responsible for ensuring you have the necessary health and fitness level to participate in the tour. You must inform us of any existing or new medical conditions. You should be able to board and leave vehicles without assistance from our staff. Due to space limitations, we cannot accommodate wheelchairs or walkers on our touring vessels, and our vehicles lack wheelchair lifts or ramps. If you need special assistance, you must travel with someone who can help you. Our staff can provide general assistance during the tour but cannot offer regular medical care or act as personal carers. If you’re uncertain about your ability to join the tour, please contact us before booking.

Existing Medical Conditions

If you have a medical condition that might increase your need for medical attention or affect the tour’s conduct, you must inform us when booking. We may ask for a medical assessment from a qualified doctor. If the assessment shows you’re unfit to travel or need assistance we can’t provide, we may cancel your booking and refund any payments made, provided you informed us of your condition at the time of booking. If you don’t provide the medical assessment promptly, it will be considered a cancellation by you, and cancellation fees will apply.

New Medical Conditions

If you develop a new medical condition or an existing one changes, which might increase your need for medical attention or affect the tour’s conduct, you must inform us. We may request a medical assessment. If it indicates you’re unfit to travel or need assistance we can’t provide, or if you don’t provide the assessment promptly, it will be considered a cancellation by you, and cancellation fees will apply.

General

We may refuse to confirm your booking, allow you to start the tour, or remove you from the tour without liability or refund if you have an illness, injury, disease, or other medical condition that makes travel unsafe for you, other guests, or our staff.

Dietary Requirements

Any special dietary requirements need to be received at least 4 weeks before departure. We will endeavour to communicate your requirements to all relevant suppliers. However, we cannot guarantee requests will be met by suppliers. It is your responsibility to check that meals and beverages do not contain any allergens. We expressly disclaim any liability for meals or beverages that contain allergens other than in circumstances where we have been negligent.

Inclusions

The price of your tour includes:
– All accommodation as listed in the itinerary
– All transport listed in the itinerary
– Sightseeing and meals as listed in the itinerary. Unless otherwise stated.
– The services of a driver/guide

Exclusions

The price of your tour does not include:
– International or internal flights.
– Airport transfers, taxes and excess baggage charges
– Meals other than those specified in the itinerary
– Travel insurance
– Optional activities and all personal expenses.
– Alcoholic beverages

Travel Insurance

Gekko Safari strongly recommends that you purchase travel insurance at the time of booking to adequately cover yourself against unforeseen circumstance such as emergency repatriation, medical expenses, illness, personal accident, death, loss or damage of personal items and personal liability. 

We also recommend that your travel insurance covers you for any unexpected circumstances that arise and cause you to cancel your tour with us. We strongly suggest you make sure you can be reimbursed by your insurance company should you need to cancel your booking.

Gekko Safari does not accept liability for:

– Tour cancellations
– Any medical emergency
– Personal injury
– Loss or damage to personal items

If you choose to travel with no insurance, you do so at your own risk, and we highly recommend that you familiarise yourself with our cancellation policy.

Please note, we are unable to recommend any insurance companies; it is your responsibility to make sure your travel insurance covers you for your individual needs.

Change of Itinerary

Itineraries are subject to change without notice and intended as a guide only. We reserve the right to change accommodation, campsites, and vehicles due to road or weather conditions, mechanical failure, public holidays, strikes, cultural and local events. Any additional expenses incurred by the passenger are not Gekko Safaris responsibility. Gekko Safari can give no guarantee as to the exact arrival and departure times of the tour and we will not be liable for failure to make connections with other services

Cancellation by you

If you wish to cancel your booking, notification of cancellation must be received by Gekko Safari via email. The date of the cancellation is the date on which Gekko safari receives the notification.

If You Cancel Your Tour

If you cancel your tour for any reason we will apply our cancellation charges at the following rates:

At 31 days and more of the departure date ,25% of the total coast

Between 30 and 15 days of the departure date ,50% of the total cost

Between 14 and 8 days of the departure date ,75% of the total cost

If cancelled 7 days or less of departure date there will be no refund given

Booking Transfer to another person

If, after booking your tour, you are prevented from travelling and wish to transfer the booking to another person (family member or friend), Gekko Safari will agree if the other person satisfies all the conditions applicable to the package, and subject to both persons accepting joint and several liabilities for full payment of the package price.

No refund will be made if you leave a trip for any reason after the trip has begun. No refund will be made for any accommodation, transport, sightseeing, meals or services not utilised

Cancellation by us

We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability industrial dispute, disease or other external events it is not viable for us to operate the planned itinerary. If we cancel your trip due to reasons other than a force majeure event you will receive a full refund. If we cancel your trip due to a force majeure event you will receive 100% credit to use for a future trip or a refund, less unrecoverable costs. All credits will be valid for 12 months from the original travel date of the booking.

Photos and Marketing

By participating on our tours, you give Gekko Safari consent to use images/videos taken of you whilst on the trip for advertising and promotional purposes through whatever medium it chooses. By participating in the tour, you consent to the use of your images for these purposes without entitlement to payment or other compensation. If you do not consent to the use of your images or likeness you need to inform us at least 2 weeks prior to departure.

Authority on Tour

Gekko Safari may refuse to carry a person whose behaviour is detrimental to the enjoyment of the group. By travelling with Gekko Safari, you agree to accept the authority of the guide and accept their decisions. Our staff are entitled to a safe working environment and our passengers to a safe and great holiday. Any threats to safety, being physical, verbal, or inappropriate behaviour may result in removal from the trip. If a guide requires a passenger to leave the trip no refunds will be given and that passenger will be responsible for their own travel costs and arrangements from that point

Privacy Policy

Any personal information that we collect about you may be used for any purpose associated with the operation of a trip or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the Trip.

Acceptance of Risk

You understand that our trips are adventurous and involve personal risk. You’ll visit places where political, cultural, and geographical factors may present greater dangers and physical challenges than in daily life. We assess trip itineraries using information from government foreign departments and our contacts. However, it’s also your responsibility to familiarize yourself with relevant travel information and your itinerary’s nature. By choosing to travel, you acknowledge being aware of these personal risks and accept them.

Limitation on Liability

We work with various companies, government agencies, coach companies, hoteliers and individuals to organize our trips, acting as an agent for these third parties. We are not responsible for their actions or failures. To the fullest extent allowed by law:

  • We are not liable for any loss, death, injury, or damage you may experience related to your participation in a trip or any breach of the Booking Conditions.
  • You release us and our officers, employees, agents, and representatives from any liability and waive any claims arising from your participation in a trip.
  • Any condition or warranty that would otherwise be implied by law into these Booking Conditions (Implied Warranty) is excluded.

If an Implied Warranty cannot be excluded, our liability is limited, at our discretion, to:

(i) Providing a similar trip of equivalent value; or

(ii) Refunding the total amount, we received from you for your booking.

We are not liable for any indirect or consequential loss, loss of profits, economic loss, or any indirect, special, punitive, or exemplary damages, however they arise.

Fees and Surcharges

Our trip prices are subject to variable and seasonal pricing. This means our trip prices may vary at any time in accordance with demand, market conditions and availability. It is likely that different passengers on the same trip have been charged different prices. Your best option if you like the price you see is to book at that time. Any reduced pricing or discounts that may become available after you have paid your deposit will not apply.

Luggage

Due to limited space we ask that the total weight of luggage does not exceed 15kg in a soft suitcase. Hard shell cases or voluminous articles will not be accepted. You may also bring a daypack not exceeding 4kg. Luggage is entirely at the passenger’s risk during the tour.

Group Numbers

Gekko Safari requires a minimum number of bookings in order to run each tour. If there are not enough passengers booked on a tour we may need to cancel the departure. If this is the case, we will usually notify you at least 2 weeks before the start date of your tour. Your options could be transferring to the nearest possible alternative date, opting for an alternative itinerary, or a full refund of monies paid to us

Optional Activities

Optional activities not included in the tour price do not form part of the tour or this contract. You accept that any assistance given by your tour guide or local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and the activity provider.

Claims & Complaints

If you have a complaint about your trip, please inform your tour guide or our local representative at the time in order that they can attempt to rectify the matter. If satisfaction is not reached through these means, then any further complaint should be put in writing to us within 30 days of the end of the tour. Complaints made outside this timeframe may not be considered.

Applicable Law

The laws of South Australia govern these Booking Conditions to the fullest extent allowable. Any disputes in connection with a trip or these Booking Conditions must be initiated in the courts of South Australia.
